I'd like to make this portion of my motion festive in light of black history month to show you how correlated our treatment really is, and of course concede on some clear differences. After all, not only does history tend to repeat itself, but few ever truely learn from it. It's black history month, and there's a lot to learn from it. I find these deprivations, discriminations, and unequal treatments to have strong correlations to what my black brothers suffered under the racist Democrats after the abolition of slavery, thanks to Republican Abraham Lincoln up until the Brown V. Board of Education decision, which the Democrats also hated. I do find our struggle in this Democratic-stronghold city similar to the black populations struggle in the 1950s Democrat-stronghold city of Montgomery, Alabama. Yes, the same city with Rosa Parks segregated bus incident, the city many referred to as the "Cradle of the Confederacy", it even held the Confederate Headquarters early on in the Civil War.

13 A. Obstruction of an Official Proceeding 14 The evidence detailed above provides, at minimum, a good-faith basis for 15 concluding that President Trump has violated section 18 U.S.C. § 1512(c)(2). The elements of the offense under 1512(c)(2) are: (1) the defendant obstructed, influenced or 16 17 impeded, or attempted to obstruct, influence or impede, (2) an official proceeding of the 18 United States, and (3) that the defendant did so corruptly. Id. (emphasis added). To date, 19 six judges from the United States District Court for the District of Columbia have 20 addressed the applicability of section 1512(c) to defendants criminally charged in 21 connection with the January 6th attack on the Capitol. Joshua James, 34, of Arab, Ala., pleaded guilty in federal court in Washington on Wednesday to helping lead a group that prosecutors say sent two tactically equipped teams into the Capitol and organized a cache of weapons in a hotel just outside the city. He also pleaded to one count of obstructing an official proceeding, and he may face the stiffest sentence of any Jan. 6 defendant so far, according to preliminary sentencing guidelines.

CAN politics (CNN) – Civil lawsuits seeking to hold Donald Trump accountable for the January 6, 2021, insurrection can move forward in court, a federal judge said Friday in a ruling outlining how the former President could conceivably be responsible for inciting the attack on the US Capitol. Trump's statements to his supporters before the riot "is the essence of civil conspiracy," Judge Amit Mehta wrote in a 112-page opinion, because Trump spoke about himself and rallygoers working "towards a common goal" of fighting and walking down Pennsylvania Avenue. "The President's January 6 Rally Speech can reasonably be viewed as a call for collective action," Mehta said.

"The heated rhetoric that got you riled up and brought you to Washington D.C. has not subsided. Disinformation is not only available, it's getting louder and louder every day. You weren't the only person to fall for it or to embrace it, and some have embraced it who don't even believe it. The lie that the election was stolen and illegitimate is still being perpetrated. Indeed, it is being amplified, not only on social media, but on mainstream news outlets, and worse, it's become heresy for a member of the former President's party to say otherwise. So, it needs to be crystal clear that it is not patriotism. It is not standing up for America. It is not 'legitimate political discourse,' and it is not justified to descend on the nation's Capitol at the direction of a disappointed candidate and disrupt the electoral process. Cancelling out the votes of other people with a show force is the opposite of what America stands for. It was the definition of tyranny, of an authoritarianism -- attacking the law enforcement officers trying to preserve order and our seat of government, trying to protect the public servants in the building isn't patriotism either. It's not with the military trained you to do and it's contrary the whole notion of supposedly caring about 'Blue Lives.' Maryland Man Pleads Guilty to Felony Charges For Offenses Committed During Jan. 6 Capitol Breach Defendant Threw Objects, Sprayed Fire Extinguisher, Joined Crowd Pushing Against Law Enforcement WASHINGTON - A Maryland man pleaded guilty today to felony charges related to the breach of the U.S. Capitol on Jan. 6, 2021, which disrupted a joint session of the U.S. Congress that was in the process of ascertaining and counting the electoral votes related to the presidential election. Matthew Ryan Miller, 23, of Cooksville, Maryland, pleaded guilty in the District of Columbia to obstruction of an official proceeding and assaulting, resisting, or impeding officers. According to court documents, as a mob gathered on the West side of the U.S. Capitol on Jan. 6, Miller threw an unidentifiable object at the Capitol building. At the time, he was draped in a Confederate flag. Miller then used a section of temporary barriers as a ladder to scale the walls of the west side of the plaza. He also assisted other rioters in scaling the walls and other architectural obstacles. Miller and others then moved to the Lower West Terrace and close to the tunnel area leading into the building. Miller waved his hand, and said multiple times, "Come on," as the mob chanted "Heave! Ho!" and rocked back and forth in pushing towards the tunnel entrance that law enforcement officers were attempting to secure. Multiple times, he put up his fingers and yelled, "one, two, three, push!" From this position, he also threw a few unidentifiable objects towards the Lower West Terrace tunnel. Then, at about 4:55 p.m., and at his closest position to the tunnel, Miller used a fire extinguisher to spray directly into the tunnel where law enforcement was stationed. Miller was arrested on Jan. 25, 2021, in Cooksville, Maryland. He is to be sentenced on May 23, 2022. He faces up to 20 years in prison for obstruction of an official proceeding and up to eight years in prison for assaulting law enforcement. Both charges also carry potential fines. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors. The case is being prosecuted by the U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney's Office for the Eastern District of Maryland. The case is being investigated by the FBI's Baltimore and Washington Field Offices. Valuable assistance was provided by the U.S. Capitol Police and the Metropolitan Police Department. In the one year since Jan. 6, more than 725 individuals have been arrested in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including over 225 individuals charged with assaulting or impeding law enforcement. The investigation remains ongoing. More than 165 individuals have pleaded guilty to federal charges, including 22 to felony offenses.
