Only one possible justification for equitable jurisdiction remains: that Plaintiff is a former President of the United States. It is indeed extraordinary for a warrant to be executed at the home of a former president-but not in a way that affects our legal analysis or otherwise gives the judiciary license to interfere in an ongoing investigation. The Richey test has been in place for nearly fifty years; its limits apply no matter who the government is investigating. To create a special exception here would defy our Nation's foundational principle that our law applies "to all, without regard to numbers, wealth, or rank." State of Georgia v. Brailsford, 3 U.S. (3 Dall.) 1,4 (1794).

Instead, Plaintiff has shifted tactics, unveiling a startling theory that all of the seized records including government documents bearing classification markings are his "personal" property under the Presidential Records Act (PRA), 44 U.S.C. § 2201 et seq. That theory is meritless, and the Court need not consider it because it was not raised below and is entirely irrelevant: Even if the seized records were Plaintiff's "personal" property, they would still be lawfully obtained evidence, nothing in the law would prohibit the government from using or reviewing them, and there would still be no basis for an extraordinary injunction and special-master proceeding. There is no reason for the injunction and the special-master review to continue. Plaintiff has copies of every seized record except those bearing classification markings, to which he is clearly not entitled. And Plaintiff's single dispute with the government regarding attorney-client privilege can be resolved through the process originally directed by the magistrate judge. This Court should therefore reverse the district court's injunction and direct the district court to dismiss the case.

At least one of the documents seized by the FBI describes Iran's missile program, according to these people, who spoke on the condition of anonymity to describe an ongoing investigation. Other documents described highly sensitive intelligence work aimed at China, they said. Unauthorized disclosures of specific information in the documents would pose multiple risks, experts say. People aiding U.S. intelligence efforts could be endangered, and collection methods could be compromised. In addition, other countries or U.S. adversaries could retaliate against the United States for actions it has taken in secret.

For one, a special master will cost a lot of money. Judge Cannon rejected Mr. Trump's proposal that taxpayers should foot half the bill of the review, instead saying he would be solely responsible. That includes the full cost of a vendor who will scan all the materials, as well as support staff for Judge Dearie, like an assistant who bills $500 an hour. Mr. Trump will also have to pay his own lawyers' fees as they filter thousands of pages of records and then litigate disputes about which ones can be withheld as privileged.

Besides that revision, the government moves to adopt the Amended Case Management Plan. See ECF 112, at 6-7. The government further comments on Executive-privilege review and Plaintiff's objections in the hope that the Special Master finds the comments helpful in administering the Amended Case Management Plan and considering Plaintiff's objections. Document-Review Vendor Plaintiff informed us this morning that none of the five document-review vendors proposed by the government before last Tuesday's preliminary conference were willing to be engaged by Plaintiff.
