UNITED STATES' MOTION IN LIMINE TO EXCLUDE EVIDENCE OR ARGUMENT RELATING TO GOOD-FAITH RELIANCE ON LAW OR ADVICE OF COUNSEL The Defendant, Stephen K. Bannon, is charged with contempt of Congress for willfully defying a subpoena that required him to produce records to and appear for a deposition before the U.S. House of Representatives Select Committee to Investigate the January 6th Attack on the United States Capitol ("the Committee"). Despite the subpoena's demands, the Defendant did not produce a single record and did not appear for testimony on the date designated; he did not even submit objections to compliance or properly assert a privilege in the manner required by the subpoena. Since being indicted, the Defendant has indicated that his disregard of the subpoena was purportedly justified by legal privileges and his attorney's advice regarding them, as well as other claims relating to the legal validity of the subpoena. The Defendant's excuses for non- compliance are without merit, and his erroneous reliance on privileges and purported advice of counsel is no defense to contempt. TThe deliberate failure to comply with a congressional subpoena–regardless of motivation–constitutes the crime of contempt. Any evidence or argument relating to the Defendant's or his counsel's views of the law, or the Defendant's reliance on it, should therefore be excluded at trial

Media reports about his connection with the events of January 6th resulted in many clients severing their ties with him, including individuals, businesses and even organizations in which he held directorial positions. He lost partnerships in which he was an investor and was forced to dilute his interest in these companies. He lost speaking engagements that helped to promote his business. AirBnB no longer allowed him to use their platform. He was discharged as a Lyft driver. He got a letter from TSA Precheck canceling his enrollment in the program. "National Healing"

Among the records that Donald Trump's lawyers tried to shield from Jan. 6 investigators are a draft executive order that would have directed the defense secretary to seize voting machines and a document titled "Remarks on National Healing." POLITICO has reviewed both documents. The text of the draft executive order is published here for the first time. It's not clear who wrote either document. But the draft executive order is dated Dec. 16, 2020, and is consistent with proposals that lawyer Sidney Powell made to the then-president. On Dec. 18, 2020, Powell, former Trump national security adviser Michael Flynn, former Trump administration lawyer Emily Newman, and former Overstock.com CEO Patrick Byrne met with Trump in the Oval Office. In that meeting, Powell urged Trump to seize voting machines and to appointher as a special counsel to investigate the election, according to Axios. The order empowers the defense secretary to "seize, collect, retain and analyze all machines, equipment, electronically stored information, and material records required for retention under" a U.S. law that relates to preservation of election records. [...] Additionally, the draft order would have given the defense secretary 60 days to write an assessment of the 2020 election. That suggests it could have been a gambit to keep Trump in power until at least mid-February of 2021. But the draft executive order also cites two classified documents: National Security Presidential Memoranda 13 and 21. The existence of the first of those memoranda is publicly known, but the existence of the second has not been previously reported. NSPM 13 governs the Pentagon's offensive cyber operations. According to a person with knowledge of the memoranda, 21 makes small adjustments to 13, and the two documents are viewed within the executive branch as a pair. The fact that the draft executive order's author knew about the existence of Memorandum 21 suggests that they had access to information about sensitive government secrets, the person told POLITICO.

Statement from the National Archives

On January 19, 2022, the Supreme Court denied former President Trump's "Application for Stay of Mandate and Injunction Pending Review." This means that there is no pending court order that applies to the records that former President Trump identified as privileged and that President Biden instructed the Archivist of the United States to provide to the House Select Committee on the January 6th Attack on the U.S. Capital, as described in the Archivist's letters to former President Trump dated October 13, 2021, October 27, 2021, and November 19, 2021. Accordingly, the National Archives and Records Administration is now in the process of providing these records to the Select Committee.
