Overview

Donald Trump's Georgia Indictment refers to the arrest of Donald Trump and 18 co-defendants in the state of Georgia on charges of engaging in an alleged conspiracy to fraudulently overturn the results of the 2020 United States Presidential Election. The arrest marks Trump's fourth indictment of 2023 following indictments in the Stormy Daniels Hush Money case, the alleged mishandling of classified documents case and the Capitol Insurrection case. The Georgia indictment is arguably the most serious of the four, as the state has charged Trump and the conspirators with one count of violating the state's RICO statute, which carries a sentence of 5-20 years in prison.

Background

In the aftermath of the 2020 U.S. Presidential Election, before Joe Biden was inaugurated, Trump allegedly made efforts to overturn Biden's narrow win in the state of Georgia. These included calling Georgia Secretary of State Brad Raffsperger and asking him to help "find" 11,000 votes for Trump in the state,[1] plotting to send fake electoral college voters to fraudulently certify that Trump had won Georgia[2] and illegally breaching voting machines to search for evidence of fraud.[3]

On August 14th, 2023, a Georgia grand jury indicted Donald Trump and 18 co-conspirators on charges of violating Georgia's Racketeer Influenced and Corrupt Organizations (RICO) statute. Trump is accused of committing 13 felonies in total. Others charged include Trump lawyers Rudy Giuliani, John Eastman and Jenna Ellis. White House Chief of Staff Mark Meadows is also charged in the indictment.[4] A graphic showing everyone charged was posted by the Atlanta Journal-Constitution[5] on August 15th, 2023 (shown below).



Developments

On August 21st, 2023, Donald Trump announced plans to surrender on August 24th, and he agreed to a $200,000 bond for his release.[6] He pleaded not guilty to the charges. Trump is ordered not to use social media to intimidate co-defendants or witnesses in the case. He will reportedly have a mugshot taken, [7] which would be the first of his life and the first of the four 2023 indictments to take this step.

Trump is being tried by Fulton County District Attorney Fani Willis,[8] who has moved to have the defendants tried on March 4th, 2024. Meadows and Trump have moved to get the case moved to a federal court where they believe they have a better chance of getting the case dismissed.[7]

On Truth Social, Trump has made several posts about the case, including disparaging Fani Willis and suggesting the $200,000 bond was a ploy to ensure he didn't "fly to Russia" (shown below).

Donald Trump's Mugshot is the booking photo of former President Donald Trump, released by the Fulton County Sheriff's Office after he was arrested in Georgia on charges of conspiring to overturn the 2020 United States Presidential Election results in the state. On August 24th, 2023, the Fulton County Sheriff's Office released Donald Trump's mugshot after he briefly appeared to get booked. It is the first mugshot of a United States President ever taken.
